Terms of Use
Effective date: [EFFECTIVE DATE]
These Terms are an agreement between you and [LEGAL BUSINESS NAME, e.g. Epic AI Builders LLC] ("we," "us") and cover your use of [PRODUCT NAME] (the "Calendar"). By buying or using the Calendar, you agree to these Terms. If you don't agree, please don't use it. Our Privacy Policy explains how we handle your information.
The short version
- On the Basic plan, your photos and dates are saved on your own device, not on our servers. Please save backups.
- Your plan is billed yearly and renews automatically until you cancel. We remind you before each renewal.
- Your account is for you. Please don't share your sign-in.
This summary is only a guide. The full Terms below apply.
1. What the Calendar does
The Calendar lets you add photos and names to dates such as birthdays, anniversaries, and events, view them month by month, print them at home, and export dates to other calendar programs.
The Calendar is an organizing tool. It is not a medical device or medical service, and it does not diagnose, treat, or prevent any condition, including memory loss. Please don't rely on it for medication schedules, medical appointments, or anything where a missed date could cause harm.
2. Who can use it
You must be at least 18 to buy a plan or create an account. The Calendar is offered to people in the United States.
3. Your account and sign-in
You sign in with your email address and a one-time code that we email to you. You are responsible for keeping access to your email account and for what happens under your Calendar account. Tell us promptly at [SUPPORT EMAIL] if you think someone else has gotten in.
Each account is for one customer. You may not share, sell, or transfer your access, or publish links or sign-in details. We may limit or suspend accounts when we reasonably believe this is happening.
4. Plan and price
The Basic plan costs [BASIC PRICE, e.g. $29] per year and gives you access to the Calendar, with photos and dates saved on your device.
We may later offer optional paid upgrades, such as online photo storage. You won't be charged for an upgrade unless you choose to buy it, and we will explain its price and terms first.
Prices are in U.S. dollars and don't include any applicable taxes. Payments are handled by our payment processor. We do not store your full card number.
5. Automatic renewal and cancellation
Your plan renews automatically each year at the then-current price, and your payment method is charged, unless you cancel before the renewal date. We will email you a reminder about [NUMBER, e.g. 30] days before each renewal, showing the price, the date, and how to cancel. If the price is going to change, we will tell you in that reminder.
You can cancel at any time from the Account page, by emailing [SUPPORT EMAIL], or by calling [SUPPORT PHONE]. Cancelling stops future charges. You keep access until the end of the year you have paid for.
6. Refunds
[REFUND TERMS, e.g. If you're not happy, email us within 30 days of your first purchase for a full refund. Renewals can be refunded if you contact us within 14 days of the charge.]
7. Gifts
A gift purchase gives the recipient a code that can be used once to start one year of access. [GIFT TERMS, e.g. Gift plans do not renew automatically, and the code expires 12 months after purchase unless the law requires otherwise.] Once activated, the account and its contents belong to the recipient.
8. Photos saved on your device (Basic plan)
On the Basic plan, your photos and calendar entries are stored in the web browser on the device you use. They are not sent to our servers, so we cannot see, recover, or restore them. Please understand that:
- The available space depends on your device and browser, so it may be limited.
- Your entries appear only in that browser on that device. They do not move to your phone or another computer by themselves.
- They can be lost if you clear your browsing data, change browsers or devices, or your device is lost or damaged. Some browsers may also remove stored data on their own, including when a site hasn't been used for a while.
- Anyone who can use your device and your browser may be able to see them.
You are responsible for keeping your original photos and using the "Save a Backup" feature regularly.
9. Your photos and content
Your photos and entries remain yours. On the Basic plan they stay on your device and we do not receive them. If you choose to send us a photo or other content when asking for help, we will use it only to help you. We will not use your photos for advertising.
You promise that you have the right to upload what you add, and that your use respects other people's privacy. Please only add photos and details of other people when it is reasonable and appropriate to do so.
10. Things you may not do
- Upload anything illegal, including any content that sexually exploits minors, or content that harasses or infringes the rights of others.
- Try to get around sign-in, payment, or storage limits, or access someone else's account.
- Copy, resell, or reverse engineer the Calendar, or interfere with how it works.
11. Our software
We own the Calendar, its design, and its software. We give you a personal, non-transferable permission to use it during your paid plan.
12. Changes and availability
We may improve or change the Calendar and may temporarily take it offline for maintenance. If we permanently stop offering a paid feature, we will give reasonable notice and a fair refund for the unused part of your plan where appropriate.
13. Disclaimers
To the extent the law allows, the Calendar is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that it will be uninterrupted or error free, or that it will prevent any missed date.
14. Limit on our liability
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost photos or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you. Nothing here limits rights that cannot be waived by law.
15. Ending access
You may stop using the Calendar at any time. We may suspend or end access if you seriously or repeatedly break these Terms, or if the law requires it.
16. Governing law and disputes
These Terms are governed by the laws of [STATE], except where the law of your home state requires otherwise. Please contact us first so we can try to resolve any problem informally. Any dispute that can't be resolved will be handled in the courts of [COUNTY AND STATE], except that you may use small claims court where it is available to you.
17. Changes to these Terms
We may update these Terms. If a change is important, we will email you before it takes effect. If you don't agree, you can cancel before the change applies to you.
